Effective date: 19 February 2026

1. About these Terms

These Terms of Use govern your access to and use of the Beyond Diagnosis platform and associated content and services. By accessing or using the platform, you agree to be bound by these Terms.

2. Who we are

Beyond Diagnosis is operated by Onus Pty Ltd, Sydney, New South Wales, Australia.

Contact: rita@beyonddiagnosis.app

3. Platform role

We provide only a practitioner directory and a booking facilitation platform. We do not provide medical, health, therapeutic, diagnostic, or treatment services.

4. Health information disclaimer

All content on the platform and in the Beyond Diagnosis podcast is provided for general information and educational purposes only. It is not medical advice and must not be relied upon as a substitute for advice from a qualified health professional. Users must seek appropriate professional advice before acting on any information.

5. Practitioner independence

Practitioners listed on the platform are independent third parties. Onus Pty Ltd does not employ, supervise, or control practitioners and is not responsible for practitioner services, conduct, advice, or outcomes.

6. Verification and trust signals

Verification badges, credential indicators, or trust signals only confirm that a practitioner submitted specific information and that limited checks were performed at a particular time. Verification does not mean endorsement, certification, or a guarantee of competence, suitability, safety, legality, or outcomes. It may not reflect changes after the review. You must conduct your own due diligence before engaging any practitioner.

7. User responsibility and suitability

The platform does not recommend, endorse, assign, or select practitioners or services for you. You are solely responsible for determining if a practitioner or service meets your needs and preferences. You must independently verify practitioner credentials, experience, scope of practice, and suitability before engaging any practitioner.

8. Accounts

You must provide accurate, current information when creating an account and keep your login credentials secure. You are responsible for all activity under your account. We may suspend or terminate accounts for misuse, misrepresentation, or breach of these Terms.

9. Bookings and communications

The platform only facilitates booking requests or scheduling. Practitioner–client communications and service delivery take place outside the platform. We are not responsible for practitioner availability, cancellations, fees, service quality, or outcomes.

10. Practitioner subscriptions and billing

Practitioner memberships are billed in advance through Stripe, based on the pricing shown at checkout. We do not store full payment card details. Pricing may change for future renewals with reasonable notice.

11. Refunds

Unless required by law, refunds are not provided for change of mind or unused subscription time. Billing errors will be corrected. Cancelling stops future renewals but does not refund the current billing period unless required by law.

12. Blog commenting and user content

Comments may be publicly visible. Do not post unlawful, misleading, defamatory, abusive, infringing, or sensitive personal information. We may moderate, edit, hide, or remove content at our discretion to protect users and platform integrity.

13. Prohibited conduct

Do not misuse the platform, including scraping data, interfering with security, uploading unlawful or misleading content, misrepresenting credentials, or engaging in conduct that undermines platform integrity.

14. Intellectual property

All intellectual property in the platform, branding, and original content belongs to Onus Pty Ltd or its licensors. You may use the platform for personal, non-commercial purposes only, unless otherwise agreed in writing.

15. Third-party services and links

The platform may embed or link to third-party services such as YouTube and podcast platforms. Your use of these services is governed by their own terms and privacy policies. We are not responsible for third-party services.

16. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded. To the extent permitted by law, our liability is limited to resupplying the services or paying the cost of having the services resupplied.

17. Limitation of liability

To the fullest extent permitted by law, we exclude liability for indirect, consequential, special, or economic loss, including loss of profits, data, goodwill, or business opportunity. We are not responsible for the services, conduct, advice, or outcomes of practitioners.

18. Indemnity

You agree to indemnify Onus Pty Ltd against any claims, losses, liabilities, or costs arising from your breach of these Terms, misuse of the platform, or content you submit.

19. Suspension and termination

We may suspend or terminate your access to the platform if we reasonably believe there has been a breach of these Terms, misuse of the platform, or a risk to platform integrity, users, or the business.

20. Governing law and jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales.

21. Guest content

Views, opinions, and statements expressed by podcast guests are their own and do not necessarily reflect those of Onus Pty Ltd or Beyond Diagnosis. We do not warrant or verify the accuracy, completeness, or reliability of statements made by guests or contributors. You must independently verify information and seek professional advice before acting on any content.

22. Content currency

Platform content and podcast episodes reflect information available at the time of recording or publication and may become outdated. We do not undertake to update past content. You should verify current best practices and guidance before relying on any information.

23. No professional relationship created

Accessing the platform or listening to the podcast does not create any practitioner–client, therapist–client, doctor–patient, or professional advisory relationship between you and Onus Pty Ltd, Beyond Diagnosis, or any podcast guest.

24. No emergency or crisis support

The platform and podcast are not intended for emergencies, urgent health needs, or crisis support. If you are experiencing a medical emergency, at risk of harm, or require urgent support, you must contact emergency services or a qualified health professional immediately.
